Terms of Service
These Terms of Service govern your access to and use of ThoughtSapien, an AI-assisted learning product operated from India ("ThoughtSapien", "we", "us"). By creating an account, purchasing a plan, or using the service, you agree to these terms.
1. The service
ThoughtSapien helps learners create learning paths, take structured lessons, interact with an AI tutor, and use generated or interactive learning surfaces such as diagrams, code environments, and practice widgets. The service may change over time as we improve, add, remove, or modify features.
2. Eligibility
You must be at least 13 years old to use ThoughtSapien. If you are under the age of majority where you live, you may use the service only with permission from a parent or legal guardian. The service is not currently intended for children under 13 or for school-directed use that requires student privacy agreements, parental consent workflows, or district-level data processing terms.
3. Accounts and security
You are responsible for the activity that occurs through your account and for keeping your credentials secure. You must provide accurate account information and promptly update it if it changes. If you believe your account has been compromised, contact us at hello@thoughtsapien.com.
4. Learning content and AI output
The service uses AI systems to generate explanations, examples, course outlines, tutor responses, and interactive learning content. AI output can be inaccurate, incomplete, outdated, or unsuitable for your situation. ThoughtSapien is for learning support and general education, not professional, medical, legal, financial, safety-critical, or other high-stakes advice. You are responsible for checking important information before relying on it.
5. Your content
You may submit topics, questions, code, text, learning goals, feedback, and other content to the service. You keep ownership of your content. You grant ThoughtSapien a worldwide, non-exclusive, royalty-free license to host, process, display, transmit, and use your content as needed to provide, maintain, protect, and improve the service.
The service also produces AI-generated learning content for you, such as courses, lessons, explanations, and visuals. You may use that generated content for your personal learning purposes. Generated content is provided as part of the service and may be similar to content generated for other users.
6. Acceptable use
You may not use the service to violate law, infringe rights, submit malware, attack or disrupt systems, scrape or overload the service, bypass usage limits, reverse engineer non-public parts of the service, abuse payment flows, impersonate others, or submit content that is unlawful, harassing, hateful, exploitative, or otherwise harmful. You may not use generated content to mislead others about its source or to make automated decisions that materially affect a person without appropriate human review.
7. Subscriptions, credits, and payments
Paid plans, credits, prices, renewal periods, taxes, and included usage are shown before checkout. Some usage may be metered or limited by credits. Credits are a product access mechanism, not cash, stored value, or a transferable balance. Credits may expire, reset, or be consumed according to the plan terms shown in the product. Payments are processed by Dodo Payments or another payment provider shown at checkout. Your purchase may also be subject to that provider's buyer terms.
8. Cancellations and refunds
You can cancel a subscription through the billing portal when available. Cancellation stops future renewal but does not automatically refund the current billing period. Unless required by law or stated at checkout, paid subscriptions and top-ups are non-refundable after purchase. We may provide refunds or credits at our discretion, and the payment provider may issue refunds where required by its policies, card-network rules, or law.
9. Service availability
We try to keep the service reliable, but we do not guarantee uninterrupted access, error-free operation, or permanent availability of any feature, lesson, generated output, model, provider, or integration. We may suspend access for maintenance, security, abuse prevention, legal reasons, or operational issues.
10. Termination
You may stop using the service at any time. We may suspend or terminate your access if you violate these terms, create risk for the service or other users, fail to pay amounts owed, or if we discontinue the service. Some provisions, including payment obligations, ownership, disclaimers, limits of liability, and dispute terms, survive termination.
11. Disclaimers
The service is provided "as is" and "as available." To the fullest extent permitted by law,ThoughtSapien disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, ThoughtSapien will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities. Our aggregate liability for claims relating to the service will not exceed the greater of US$100 or the amount you paid to ThoughtSapien for the service in the three months before the event giving rise to the claim.
13. Indemnity
You agree to defend, indemnify, and hold harmless ThoughtSapien from claims, damages, liabilities, costs, and expenses arising from your content, your use of the service, your violation of these terms, or your violation of another person's rights.
14. Governing law
These terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any mandatory consumer protections that apply where you live, courts in India will have exclusive jurisdiction over disputes arising out of or relating to these terms or the service.
15. Changes to these terms
We may update these terms from time to time. If changes are material, we may provide notice or require renewed acceptance before continued use. The effective date at the top shows when these terms were last updated.
